The Central African Republic: Mahamat Said Abdel Kani surrenders to the ICC

On 24 January 2021, Mr Mahamat Said Abdel Kani, also known as “Mahamat Said Abdel Kain” and “Mahamat Saïd Abdelkani” (“Mr Said”), was surrendered to the International Criminal Court (“ICC” or “the Court”) by the authorities of the Central African Republic (“CAR”) on account of an ICC warrant of arrest issued under seal on 7 January 2019. Mr Said is suspected of war crimes and crimes against humanity allegedly committed in Bangui (CAR) in 2013. When issuing the warrant of arrest, the Single Judge of Pre-Trial Chamber II, Rosario Salvatore Aitala, found that there were reasonable grounds to believe that an armed conflict not of an international character was ongoing on the territory of the CAR from at least March 2013 until at least January 2014 between the Seleka – a coalition of armed groups predominantly composed of Muslims opposed to former president François Bozizé – and the Anti-Balaka – a movement opposed to the Seleka and supportive of former president Bozizé. Moreover, the Single Judge found reasonable grounds to believe that, from at least March 2013 until at least January 2014, a widespread and systematic attack was conducted by members of the Seleka against the civilian population and those perceived to be collectively responsible for, complicit with or supportive of the former Bozizé government and, later, of the Anti-Balaka. The Single Judge found reasonable grounds to believe that Mr Said, a national of the Central African Republic, born on 25 February 1970 in Bria, was a Seleka commander and, in this capacity, he is suspected of being responsible for the following crimes: · crimes against humanity (imprisonment or other severe deprivation of liberty; torture; persecution; enforced disappearance; and other inhumane acts; and · war crimes (torture and cruel treatment). Mr Said is suspected of having committed these crimes jointly with others and/or through others or ordered, solicited or induced these crimes or aided, abetted or otherwise assisted in the commission of these crimes; or in any other way contributed to the commission or these crimes. The ICC Registrar, Mr Peter Lewis, thanked the authorities of the CAR and of the host State, The Netherlands, for their cooperation in the arrest and surrender of Mr Said to the Court. The initial appearance of Mr Said before the Single Judge of Pre-Trial Chamber II, Judge Rosario Salvatore Aitala, will take place in due course. Background: On 30 May 2014, the Government of the CAR referred the situation in the CAR since 1 August 2012 to the Court. The situation reportedly involved alleged crimes committed by both the Seleka and the Anti Balaka. The violence allegedly led to thousands of deaths and left hundreds of thousands displaced. On 24 September 2014, the ICC Prosecutor, Ms Fatou Bensouda, opened an investigation in relation to this situation. The ICC has another ongoing case in this situation, concerning Alfred Yekatom and Patrice-Edouard Ngaïssona. The trial in this case is scheduled to open on 9 February 2021. Lors de la délivrance du mandat d’arrêt. le juge unique de la Chambre préliminaire II, Rosario Salvatore Aitala, a estimé qu’il y avait des motifs raisonnables de croire qu’un conflit armé ne présentant pas de caractère international était en cours sur le territoire de la RCA, entre au moins mars 2013 et au moins janvier 2014, entre la Séléka (une coalition de groupes armés principalement composée de musulmans opposés à l’ancien président François Bozizé) et les anti-Balaka (un mouvement opposé à la Séléka et soutenant l’ancien président François Bozizé). De plus, le juge unique a estimé qu’il existait des motifs raisonnables de croire que, de mars 2013 au moins jusqu’à janvier 2014 au moins, une attaque généralisée et systématique a été menée par des membres de la Seleka contre la population civile et les personnes perçues comme étant collectivement responsables ou complices ou apportant leur soutien aux actes de l’ancien gouvernement de François Bozizé, et, ensuite, des anti-Balaka. Le juge unique a trouvé des motifs raisonnables de croire que M. Said, un ressortissant de la République centrafricaine, né le 25 février 1970 à Bria, était un commandant de la Séléka et, à ce titre, est soupçonné d’être responsable des crimes présumés suivants : · crimes contre l’humanité (emprisonnement ou autre forme de privation grave de liberté physique, torture, persécution, disparitions forcées et autres actes inhumains), et · crimes de guerre (torture et traitements cruels). M. Said est suspecté d’avoir commis ces crimes conjointement avec d’autres et/ou par l’intermédiaire de ceux-ci, ou d’avoir ordonné, sollicité ou encouragé la commission de ces crimes, ou d’avoir apporté son aide, son concours ou toute autre forme d’assistance à leur commission, ou d’y avoir contribué de toute autre manière. Le Greffier de la CPI, M. Peter Lewis, a remercié les autorités de la République centrafricaine et de l’État hôte, les Pays-Bas, pour leur coopération lors de l’arrestation et de la remise de M. Said à la Cour. La comparution initiale de M. Said devant le juge unique de la Chambre préliminaire II, Rosario Salvatore Aitala, aura lieu dans les meilleurs délais. Contexte : Le 30 mai 2014, le gouvernement centrafricain a saisi la Cour de la situation en RCA depuis le 1er août 2012. Cette situation aurait impliqué des crimes présumés à la fois des groupes Séléka et des groupes anti-Balaka. Les violences auraient entraîné des milliers de morts et le déplacement de centaines de milliers de personnes. Le 24 septembre 2014, Mme Fatou Bensouda, Procureur de la CPI, a ouvert une enquête sur cette situation. La CPI a ouvert une autre affaire en cours dans cette situation, concernant Alfred Yekatom et Patrice-Edouard Ngaïssona. L’ouverture du procès dans cette affaire est prévue le 9 février 2021.
